Different fees must be paid during the patent application process, and after a patent is granted. The amount of those fees is shown in the lists below.

  Fee adjustments – what fee do I pay?

  For fees subject to an adjustment, the fee amount you must pay depends on the date which the fee is received by the Commissioner Footnote 1 , not the date which the service was originally requested, nor the prescribed date to pay the fee.

  How to determine what fee to pay

  For all fees subject to an adjustment:

  • If payment is received before January 1 of next year, you will need to pay the prescribed fee for the current year.
  • If payment is received on or after January 1 of next year, you will need to pay the adjusted prescribed fee for next year.

  For example, if you file a patent application but your filing date is not granted because you failed to pay a prescribed fee, the amount you need to pay will depend on the date which the Commissioner receives payment of your entire prescribed fee.

  Similarly, the amount due for a maintenance fee depends on the date which your payment is received, not the prescribed date to pay the fee. This applies whether the fee is paid early, during the late fee period, or during the reinstatement period.

  In respect of international applications during the international phase, some fees are payable to CIPO for its own benefit and some fees are collected by CIPO for the benefit of the World Intellectual Property Organization (WIPO).
